As a registered user of our platform, we would like to inform you about our updated service agreement, which will take effect on March 18, 2025.
This agreement update reflects the requirements of the amended Personal Information Protection Law of the People's Republic of China.
We are committed to protecting your personal data privacy, and as part of our privacy protection practices, we emphasize that this service agreement applies throughout your use of our platform.
In this agreement, "Proergy (Suzhou) Energy Technology Co., Ltd." is referred to as "we," "us," or "our," and "data subject" is referred to as "you" or "your."
(1) Account Registration Service
We provide account registration services through email or phone number, allowing you to have your own account.
(2) Online Photovoltaic Power Station Creation Service
You can create an online power station based on your physical power station information and add our equipment to achieve the purpose of mapping your real power station.
(3) Data Collection Service
We collect data from devices such as inverters, micro-energy storage systems, and electricity meters, and send the data to our cloud service system, which will process and store the data.
(4) Big Data Statistics Service
We use our big data system to analyze the collected data and display real-time and historical data of power generation, power consumption, charging, and discharging on your power station (depending on your connected equipment and grid type).
(5) Abnormal Information Alarm Service
You can view the alarm messages and offline messages of power stations and equipment.
(1) Processing
To provide the above services, we need to process your personal data, including: collection, recording, organization, structuring, storage, modification, retrieval, consultation, use, disclosure, dissemination or otherwise making available, alignment, combination, restriction, erasure or destruction, whether or not by automated means.
(2) Information Provision
When we collect your personal data, we will provide you with the following information:
A. Our identity and detailed contact information, and when appropriate, the identity and detailed contact information of our representatives
B. Contact details of the data protection authority, when appropriate
C. Information about personal data recipients, if any
D. Appropriate security measures we have taken
(3) Records
We record and retain your personal data collected when using our PROERGY Smart application software and PROERGY Portal webpage for legal or business purposes, to provide services, fulfill our legal obligations, and execute our mutual agreements.
(4) Communication
We will notify recipients of any corrections, deletions, and processing restrictions made under Article 3, Sections 2/3/4/5 of this agreement, unless notification is impossible or involves inappropriate actions. We will also inform you about these recipients upon your request.
(5) Security
We use reasonable technical measures to protect your collected personal data. We also take a series of measures to prevent security vulnerabilities and unauthorized access to personal data.
A. We will promptly inform you of: basic details and potential impacts of security incidents, measures we have taken or will take, suggestions for self-protection and risk reduction, and remedial measures. We will notify you through email, letter, phone, push notification, or other means. When individual notification is impractical, we will issue announcements through reasonable and effective means.
B. We will also report the handling of user information security incidents to regulatory authorities as required.
C. In the event of service termination, we will take reasonable measures to protect your user information security, including stopping the collection of your information, notifying you individually or through announcements, and deleting or anonymizing your personal information.
D. If we need to use your information beyond the stated purpose or reasonable scope, we will inform you again and obtain your explicit consent.
(6) Notification
In the event of a personal data breach, where feasible, we will notify the data protection authority within 72 hours of discovery, unless the breach is unlikely to result in any risk to individual rights and freedoms. If we do not notify within 72 hours, we will provide an explanation.
When a personal data breach is likely to result in high risk to your rights and freedoms, we will notify you without undue delay.
(1) Right of Access
You have the right to know whether we are processing your personal data, and if so, you have the right to know what personal data we hold, how we use it, and who we share it with. You have the right to file complaints with data supervisory authorities.
(2) Right to Rectification
You have the right to request correction of your personal data without undue delay, and you have the right to complete incomplete personal data, including by providing a supplementary statement.
(3) Right to Erasure
You have the right to request deletion of your personal data, and we are obligated to delete your personal data without undue delay in any of the following circumstances:
A. The personal data is no longer necessary for the purposes of collection or other processing
B. The personal data has been unlawfully processed
C. The personal data must be deleted to comply with our legal obligations under the Personal Information Protection Law of the People's Republic of China
(4) Right to Restriction of Processing
You have the right to request restriction of processing in any of the following circumstances:
A. You contest the accuracy of the personal data, allowing us time to verify its accuracy
B. The processing is unlawful, and you oppose the erasure and request restriction of use instead
C. We no longer need the personal data for processing purposes, but you require it for establishing, exercising, or defending legal claims
(5) Right to Object
You have the right to object to our processing of your personal data, and we will consider your request. Please provide us with reasons for your objection so we can assess whether we have compelling legitimate interests to continue processing the data or need to process it for legal claims.
(1) You consent to our processing of your personal data for providing the services described in Section 2.1. You also have the right to withdraw this consent at any time. However, the withdrawal does not affect the legal validity of data processing based on your consent before withdrawal.
If you do not agree to the terms of this agreement or withdraw consent at any time, we have the right to terminate this service agreement.
(2) To better serve you, you agree that we may, at our discretion, disclose your personal data to equipment suppliers and installers.
(3) You agree not to engage in any activities that may interfere with our system's normal operation or any actions we consider potentially harmful to your personal information security.
(4) You acknowledge and agree that you have full capacity and authority to disclose or provide any personal data to us. You guarantee that our use of this data information under this service agreement will not expose us to any claims, liabilities, or litigation.
(5) You acknowledge and agree that some of your data information provided to us may be transferred, stored, or processed at our branches and equipment service institutions covered by this agreement. This may be different from your location, and therefore this information may be subject to overseas jurisdictions.
(6) You acknowledge and agree that such overseas transfer or processing of information is necessary for managing your account and providing services, and you consent to our doing so. You further agree that we process this information based on your interests according to the terms of this agreement, and you authorize us to transfer, store, and process this data information to these countries and regions to provide the services agreed upon in the service agreement.
(7) You acknowledge and agree that we have the right to delete, modify, or refuse any content you submit, post, or display on our PROERGY application software that we consider illegal, in violation of this agreement's terms, or potentially causing liability to us or our branches.
Unless otherwise specified in the terms and conditions of relevant services, we shall not be liable for any delay, failure, or interruption of content or services caused directly or indirectly by natural acts, forces, or reasons beyond our reasonable control. These factors include but are not limited to: Internet failures, computer viruses, network attacks, long-distance or any other equipment failures, power failures, strikes, labor disputes, riots, rebellions, civil unrest, labor or material shortages, fire, flood, storm, explosion, acts of God, war, government actions, orders from domestic or foreign courts or tribunals, or non-performance by any third party.
This agreement shall be governed by Chinese law, regardless of its conflict of law provisions. Both parties to this agreement submit to the jurisdiction of the courts in Suzhou, Jiangsu for dispute resolution.

We reserve the right to modify these terms of service at any time. Please review them frequently. If we decide to make any changes to the terms in any written form, we will notify you via email or on the PROERGY application software before the modified version takes effect. In any case, your continued use of any services will constitute acceptance of any such changes.
